Is Jennifer Hudson’s ex-fiancé David Otunga cleared in alleged domestic violence investigation?

ABC/Fred LeeIt appears that Jennifer Hudson‘s ex-fiancé David Otunga will not be charged for an alleged domestic violence incident involving Hudson.

Jennifer and David had been engaged since late 2008.

According to TMZ, the police investigation is now reportedly complete and David will not be charged. As previously reported, Otunga’s attorney released a statement, obtained by ABC News, in response to Hudson filing a protective order against him.

The statement, which came after reports that Jennifer and David split in November, added that David “never abused or harassed Ms. Hudson or their son, and it is unfortunate, especially in today’s climate, that she would feel the need to make these false allegations against him.”

The statement also detailed that Otunga had been “trying to negotiate the terms of an amicable parenting agreement with Ms. Hudson for several weeks now.”

In addition to the alleged domestic violence incident, both parties have since been engaged in a custody battle over the couple’s eight -year-old child, David Daniel Otunga Jr. Jennifer, according to David’s statement via his attorney, filed “a meritless Petition for Order of Protection in an effort to gain an unfair advantage in the custody dispute.”

ABC News has reached out to David Otunga’s attorney for a statement.
